Terms of Service

Commit Apps, SRL ("us", "we", or "our") operates the HydraVPN mobile app (hereinafter referred to as the "Service").

  1. This is an agreement between you and Commit Apps SRL for virtual private network communications services, related services and features. It is NOT a service for the commission of criminal acts. It is an anonymity and privacy service. You agree not to violate any laws of any jurisdiction you are originating from, or terminating into.
    The parties acknowledge that no reliance is placed on any representation made but not expressly contained in these terms.
  2. Please carefully read all our terms and conditions. When you click to install our Service applications, you are agreeing with all the terms and conditions of the Service. And if you don't agree, you can cancel the installation, and you must destroy, return or delete all copies of our applications in your possession.
  3. You agree not to use the Service for sending spam, port scanning, scanning for open proxies or open relays, sending opt-in email, unsolicited email or any type or version of email sent in large quantities even if the email is ultimately sent off of another server. You agree not to attack in any way shape or form any other computer or network while on our Service.
  4. Actual service coverage, speeds, locations and quality may vary. The Service will attempt to be available at all times except for limited periods for maintenance and repair. However, the Service may be subject to unavailability for a variety of factors beyond our control including emergencies, third party service failures, transmission, equipment or network problems or limitations, interference, signal strength, and may be interrupted, refused, limited or curtailed. We are not responsible for data, messages or documents lost, not delivered, delayed or misdirected because of interruptions or performance issues with the Service or communications services or networks (e.g., T-1 lines or the Internet). We may impose usage or Service limits, suspend Service, or block certain kinds of usage in our sole discretion to protect users or the Service. Network speed is an estimate and is no indication of the speed at which your or the Service sends or receives data. Actual network speed will vary based on configuration, compression, network congestion and other factors. The accuracy and timeliness of data received is not guaranteed; delays or omissions may occur.
  5. Hacking, cracking, distribution of viruses, fraudulent activities, network sabotage, phishing, and/or any conduct deemed illegal or unwanted shall be subject to suspension or termination. Users are responsible for the proper secure configuration of their services and are responsible for any damages caused by their neglect or exposure of vulnerabilities whether intentional or unintentional.
  6. We do not put any cap on data usage per user however the use of Service is subjected to fair usage. Creating automated or manual VPN sessions in a manner that would impersonate a bot or exerting excessive load on the network that may disturb other users on the network or utilizing substantially excessive bandwidth that exceeds the average user bandwidth usage for an extended duration of time, all are considered as unfair usage of the network. We reserve the right to temporarily suspend or permanently terminate users found involved in unfair usage of its services.
  7. You may not assign or transfer your rights or obligations under these terms to any third party.

  8. When installing the Service, you will be granted a limited, 1 hour free trial period. After the trial period is over, you will be required to purchase a subscription plan in order to continue using the Service. If you choose to purchase a subscription, please note:

    • The payments will be charged to your iTunes account at confirmation of purchase.
    • The subscription plan automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
    • Your account will be charged for renewal within 24hours of the end of the current period, and the cost of the renewal will be provided.
    • Subscriptions may be managed by the user. Auto-renewal may be turned off by going to the user's Account Settings after purchase.
    • No cancellation of the current subscription is allowed during active subscription period.
    • Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication.
  9. These terms and your use of the Service are governed by the laws of Moldova, without regard to its choice of law provisions. You agreed that the courts of general jurisdiction located in Moldova, will have exclusive jurisdiction over any and all disputes arising out of or relating in any way to these Terms or the Service.

Our DMCA Policy

Commit Apps SRL is a service provider of transitory digital network communications under the Digital Millennium Copyright Act ("DMCA") 17 U.S.C. p. 512(a). Accordingly, it is our policy to promptly terminate without notice the accounts of those determined by Commit Apps SRL to be repeat infringers, where a repeat infringer is an end user of the Commit Apps SRL Services who has been notified by Commit Apps SRL of infringing transmissions activities more than twice ("Repeat Infringer Policy"). Because of the ephemeral nature of transmissions imitated at the direction of persons using the Commit Apps SRL Service, it is generally not possible for Commit Apps SRL to take-down content from its system, but it will use all reasonable efforts to identify the offending persons in order to enforce its Repeat Infringer Policy.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.
